Look, I agree with most of your post. But it is legal and possible to sell/trade your 4xE. The federal law against selling cars with open recalls only applies to Dealer NEW vehicle inventory.

You can take your B9A-ridden 4xE to a dealer for a trade and not even mention the recall. Of course, the market price is currently down because of the recall, so you're probably gonna take a bit of a bath on that. But I think more and more owners are starting to consider cutting their losses the longer the lack of software flash goes on...
Hmm. Not my experience. CarMax and two dealers said nope they couldn't (and wouldn't) buy my 4xe because of the recall. Your linked article mentions selling a used car with a recall that a dealer already had but nothing about buying one.

This was also confirmed when I was complaining to Jeep Cares. They said they knew dealers couldn't buy it and that I couldn't trade it. It's the B9A recall that's the issue where there is no solution. If there was a fix they could buy it (and then fix it before reselling).

If you have a link to actual laws stating dealers are allowed that would be helpful.
 
Federal law (Federal Motor Vehicle Safety Act) prevents dealers from selling new vehicles with open recalls. Some states have laws that prevent dealers from selling used vehicles with open recalls, but there is no federal law preventing it.

Yeah but we're talking about dealers buying a vehicle with an open recall that has no resolution. Thats the point here in that 4xe owners are stuck at the moment until there is a fix.

Federal law definitely doesn't prevent them from buying with an open recall, but if they're in a state that won't allow them to sell it, they obviously wouldn't be inclined to purchase it.
 
Would be curious to hear if anyone is successful trading or selling their 4xe while there's no resolution. Dealers likely don't want to tie up their cash and take on the liability.
